Prior to August 9, 2019, transient accommodations in NJ, including rooms, residences, and online rental marketplaces, were subject to an additional sales tax and a state occupancy charge for all taxable transient accommodations, which drove up rental prices for both owners and renters.
Thankfully, Governor Murphy decided to sign an Amendment to Bill A-4814 which exempts private rentals from charging the renters taxes on short term transient accommodations to the benefit of late summer beachgoers. Personal rentals available at the Jersey Shore and the rest of the state are now exempt from this tax as long as the property owner owns less than three rental units.
Any renters who have rented rooms from an owner through Shore Summer Rentals will not owe the Transient Accommodations Tax, as long as their stay began on or after August 9, 2019. If a renter has already paid a transient accommodations tax for their stay taking place after the reversal date, the property owners are required by law to refund the tax amount. However, if the stay took place before the reversal date, the tax still applies.
The Transient Accommodations Tax reversal is good news for both rental property owners and their renters, as it will keep rental costs down and increase room rentals for the remainder of the summer season and throughout the year.
