Auto Accident Attorney Gloria Seidule Explains About Car Accident Cases

Changes to the Personal Injury Protection (PIP) coverage mean that auto accident victims cannot make a claim if treatment is not obtained within 14 days of the accident. Auto accident attorney explains the implications of these changes and steps that victims should take if they meet with an accident

Stuart, FL -- (SBWIRE) -- 12/10/2014 -- The Florida Legislative had last year announced sweeping changes to the Personal Injury Protection Law wherein victims of car accidents had to not only seek medical treatment within 2 weeks of the accident, but they also had to prove that the accident had caused an 'emergency medical condition' to claim the entire coverage amount of $10,000. Personal injury lawyer Gloria Seidule explains about things that victims should know to safeguard their interests.

"PIP is mandatory in Florida; but accident victims can be denied from making a successful claim if they not seek medical treatment within 2 weeks of the injury. Also, treatment received for the injury should be related to the initial injury diagnosis. Also, the injury should be claimed to be an 'emergency medical condition' by a registered nurse practitioner, physician or osteopathic physician, and not from alternative remedy professionals like chiropractors," says Gloria.

The insurance company is also within its rights to demand that the claimant take an examination under oath. Without an oath they could refuse to pay if the insured person refuses the examination under oath. Liability coverage isn't mandatory, but the person causing the accident would still be liable. Also, when children turn 18, it makes sense to take a separate policy. But if the child drives the car occasionally, their name can be added as a driver on the main driver's policy.

She advises car owners to purchase uninsured motor insurance coverage to help them with the high costs in accidents involving uninsured drivers. "With more than 7 million uninsured motorists, Florida ranks second most in the list of states with the most number of uninsured drivers," says Gloria.
